On June 23 rd , 2022, the Parliament of Canada passed legislation to extend the term of copyright protection in literary, dramatic, musical and artistic works from life of author plus 50 years to 70 years. additional editions on average after it enters the public domain. The court (Justice Gautam Patel) reasoned that Section 15(2) only talks about designs, not artistic works and the Designs Act explicitly excludes artistic works from the definition of design. The upshot was that those drawings, not being designs, could retain copyright as artistic works (since 15(2) didnt apply to them).
