It was found that the order was arbitrary and passed without due application of mind.

Ellis took the photo in 2003 and registered it with the Copyright Office in 2008. Complex Media posted Minden’s photo over 10 years ago. Under the discovery rule, an infringement claim does not “accrue” until the copyright holder discovers, or with due diligence should have discovered, the infringement.
